id have to say pulling into the hard shoulder to answer the call would pose more of a danger, the driver would be worried about missing the call but dosent want to answer while driving so rushes to the hard shoulder being reckless and not paying attention to others on the road.

Well ive always ignored this law and found it rather stupid especially on motorway, driving around town changing gears etc big no no but motorway mhe... untill today, i was watching traffic cops and this lorry driver went straight up the arse of a stopped car in traffic doing 60mph, the girl in the car was 23 and killed instantlly as the car was crushed in to nothing. needless to say the lorry driver was scrolling through the phonebook on his hands free in cab phone and got 4 years prison + 7 year ban for causing death by dangerous driving....

now talking on ur phone isnt really that much of a distraction unless u are mentally retarded and cant talk + watch road in which case u shouldnt be driving anyways, however the temptation to play with the phone coz uve got it (like search for someone in phone book to ring them or similar) is the key distraction, even just looking down for that split second to c who is calling + press answer/reject is very very dangerous and this applies also to ur radio/sat nav and whatever other toys u have. it is my personal opinion and belief that if it requires you to take ur eyes off the road then its a danger simple as... so dont use it.

How can talking on the phone via bluetooth be any more dangerous than having a passenger to chat to? I also don't understand why some people feel the need to answer any call straight away (ok so the above is a good exception) but a lot of people who won't be getting a majorly important call still *have* to answer straight away. A lot of my friends look bemused when I leave phones ringing because I'm doing something else. Usually it can just wait.

Really I think that both options are equally dangerous. The hard-shoulder is for emergency use only so don't stop on it to answer the phone. And people really can be quite incapable with a phone in their hand
